1. Purpose
These Terms of Service govern the access and use of the <strong/> platform, an Artificial Intelligence (AI) generative content suite operated from France. By creating an account or accessing the suite (including Image Studio, Video Studio, Character Lab, and Audio generation tools), the user accepts these terms in their entirety. You must be at least 18 years old to use the platform.
2. Credit System and Subscriptions
<strong/> The service operates on a strictly prepaid DX Credits system. Credits are consumed dynamically based on the type of processing (e.g., Image Generation, Video Rendering under Kling or Minimax, Audio Synthesis).
<strong/> DXBUILDER applies operational processing multipliers (e.g., 2.2x for DX Video Mini, up to 5.0x for 4K Professional Upscales) depending on the selected AI model's prompt optimization, output quality, and rendering duration.
<strong/> Subscription Plans (PRO, STUDIO, ULTIMATE) renew monthly. Unused base subscription credits expire at the end of the billing cycle unless explicitly stated otherwise or supplemented by active one-off "Top-Up" packages.
<strong/> The ULTIMATE plan offers a <slow/> (shared pool, no credit cost for base images/prompts) and a <fast/> (priority dedicated GPU processing consuming your credits instantly).
3. Refund Policy
Due to the immediate nature of high-cost computing resource consumption (GPU inference via third-party APIs including Hedra, Kling, MiniMax, and Suno) and the instantaneous delivery of digital content, <strong/>.
No refunds, prorations, or chargebacks will be issued for credits already used or for subscriptions once any AI generation task has successfully commenced under your account.
4. Intellectual Property & Licensing
<strong/> The user holds the full commercial and personal rights to the images, videos, character sheets, and audio generated through the platform, provided the user holds an active, paid subscription (PRO, STUDIO, or ULTIMATE) at the time of creation. Assets generated on the FREE tier are licensed strictly under Creative Commons Non-Commercial (CC BY-NC 4.0).
<strong/> DXBUILDER retains all corporate rights, intellectual property, and licensing to the underlying prompt optimization engines, platform architecture, user interface, and proprietary routing algorithms.
5. Limitation of Liability & Acceptable Use
<strong/> Artificial Intelligence is inherently unpredictable and may generate inaccurate, offensive, or unexpected results ("hallucinations"). DXBUILDER acts as an intermediary interface and is not responsible or liable for any misuse, interpretation, or public distribution of the content generated by the user.
<strong/> Users are strictly prohibited from generating deepfakes of non-consenting real individuals, highly explicit (NSFW) material, or content intended to deceive, misinform, or bypass copyright laws. Violations will result in immediate termination without refund.
6. Dispute Resolution
In the event of a dispute, misunderstanding, or claim arising from the use of DXBUILDER, the parties agree to first attempt an amicable resolution through our designated support channels. Should informal resolution fail, the competent and exclusive jurisdiction will be the applicable Courts of France, operating under French and European Union digital laws.
Acceptable Use Policy (Zero Tolerance) & Content Responsibility
DXBUILDER acts exclusively as a technology infrastructure (PaaS) and AI optimization provider. By using our services, the User expressly agrees to the following rules of conduct. Any violation will result in an immediate and permanent account ban, without right to any refund, and, if applicable, reporting to the competent authorities.
1. Absolute Prohibitions
It is strictly prohibited to use DXBUILDER's text, image, or video generation engines to create, optimize, or distribute:
Illegal Content: Any material that violates local, French, or international laws.
Abuse Material & CSAM: Any representation of abuse, exploitation, or sexualization of minors.
Non-Consensual Deepfakes: Explicit or defamatory images or videos of real people without their express consent (Non-Consensual Pornography / NCII).
Extreme Violence & Terrorism: Promotion of terrorist acts, self-harm, or gratuitous extreme graphic violence.
Fraud & Disinformation: Creation of material intended for fraud schemes, identity theft, or organized public disinformation campaigns.
Copyright Infringement: Intentional generation of material that infringes trademarks or third-party intellectual property rights.
2. Exclusive User Responsibility
The User assumes full and exclusive responsibility (civil and criminal) for all content generated through their account. DXBUILDER does not actively monitor all generations in real-time but reserves the right to investigate accounts flagged by internal security algorithms or external reports.
3. Indemnification Clause (Hold Harmless)
The User agrees to indemnify, defend, and hold harmless DXBUILDER SASU from any claim, lawsuit, damage, cost, or expense (including attorney's fees) resulting from the use of the platform for illicit purposes or the violation of these terms.
